Article I: Name and Purpose
Section 1 Name: The official name of this organization shall be Education Minnesota
Student Program, EMSP.
Section 2 Date: Constitution submission date: May 11,2005.
Section 3 University Policies: This group shall abide by the applicable rules and policies of the University of Minnesota, Morris pertaining to students and their organizations.
Section 4 Purpose: The purpose of this organization shall be to: Promote interest in and enthusiasm for the field of education, to promote awareness and provide
information regarding educational issues, to promote professionalism in the field of education, to develop a stronger relationship with the surrounding school districts, and to provide support for underclassmen who are pursing education majors.
Section 5 Affiliation: We are affiliated with Education Minnesota, which includes the
following: The American Federation of Teachers, National Education
Association, and American Federation of Labor - Congress of Industrial
Organizations.
     
Article II: Membership
Section 1 Membership is open to all students without regard to race, religion, color, sex, national origin, disability, age, creed, marital status, public assistance status, veteran status or sexual orientation.
Section 2 Eligibility for Membership: Voting membership is open to all students at the
University of Minnesota, Morris.
Section 3 Membership Criteria: To become a member one must be enrolled or interested in teacher education programs at UMM and pay appropriate dues as stated in the constitution by-laws.
Section 4 Removal of Officers/Members: Any member or officer may be impeached for
misconduct as defined by the group, such as failure to perform duties, misuse of funds, and displaying behavior that jeopardizes relations with any cooperative students, teachers, and administrators. The member/officer and EMSP voting membership shall be given a two-week notice, via e-mail, of an impending removal. The member/officer will be given an opportunity to defend him/herself at the meeting and/or in writing. This impeachment vote shall require a simple majority vote by members present at the meeting.
Section 5 Appeal of Removal: If the impeached officer/member believes that due process has not been followed, he/she may appeal the impeachment to the UMM Director of Student Activities.
     
Article III: Executive Officers
Section 1 Officer Positions: The Executive Officers of this group shall consist of two co-
Presidents, a secretary, and treasurer.
Section 2 Officer Criteria: All Executive Officers of this group must be UMM students enrolled as full-time students. The officers must also be active members of Education Minnesota, NEA, AFT and have been a member of EMSP for a minimum of one semester.
Section 3 Officer Duties: The duties of the Executive Officers are as follows:
  a. Co-President:
 
1)
Preside at all business meetings and meetings of the Executive Committee.
 
2)
File constitution, bylaws, annual mailing lists, and names of officers with the Education Minnesota state wide office.
 
3)
Call meetings of the Executive Committee or poll the members of the
Executive Committee as business necessitates.
 
4)
Perform all other duties usually pertaining to the office, which include
promoting and organizing events, recruiting new members, communicating with the faculty adviser and other school district personnel, etc.
  b. Secretary:
 
1)
Record the minutes of all meetings including those of the Executive
Committee. In the event of absence, he/she will ~trrangefor a substitute.
 
2)
Forward approved minutes to all EMSP members.
 
3)
Maintain a file containing the constitution, bylaws, mailing list, and the
minutes of meetings.
 
4)
Perform other duties as requested by the President.
  a. Treasurer:
 
1)
Serve as custodian of all funds for the chapter.
 
2)
Keep an itemized account of all receipts and disbursements.
 
3)
Submit an annual written financial report to the Executive Committee and submit brief financial reports when requested by the President, Student Activities Office, or Education Division.
 
4)
Work directly with the Student Activities Office and the Education Division in matters of funds, including membership dues.
 
5)
Pay all budgeted bills when properly verified by the person incurring the
indebtedness.
 
6)
Perform other duties as requested by the President.
Section 4 Election of Officers: Executive Officers shall be elected by a simple majority vote of members present at the meeting.
Section 5 Election Timeline: Voting for Executive Officers shall be held at the second to last business meeting of spring semester. Members will be notified via e-mail of the impending election at least two weeks in advance. Nominations for officer position will be made at the meeting prior to elections by any EMSP member for another EMSP member including his or herself.
Section 6 Term of Office: Newly elected Executive Officers shall work with current officers until the ynd of the year for training purposes. All executive positions with the exception of President will assume all duties assigned the following Fall semester. The Presidential position will be shared by the President elect and current President(s) for the fall semester following elections to provide support and training for the newly elected President. Terms will run for one year for the vice President, secretary, and treasurer offices. The President's term will run for one and one half years with the first semester serving as a mentorship with the current President, then assuming over full responsibilities starting spring semester. The Presidential term will function in this way because student teaching requirements for education majors.
Section 7 Vacancy of Office: In the event of a vacancy in an office (by resignation or
removal). the vacancy will be filled as follows: If a Co-President office becomes
vacant, the remaining Co-President will assume full responsibility as President and a special election will be held to elect a Co-President. If the secretary or treasurer office becomes vacant, a special election will be held. A special election will be held within two weeks of vacancy following the procedures specified in Section 4.
     
Article IV: Meetings
Section 1 Frequency: A regular meeting shall be held monthly during the academic year.
Section 2
Business: A quorum must be present in order to conduct official business of the club. A quorum shall consist of at least half of the current EMSP members.
Section 3 Decisions: Decisions of the club shall be enacted by a majority vote using Roberts Rules of Order.
Section 4 Special Meetings: Special meetings may be called by any Executive officer for
pertinent reasons including special elections, special events, or urgent business. Members will be notified of a special meeting through email and postings on the Education bulletin board at least 24 hours in advance.
     
Article V: Adviser
Section 1 Responsibilities: The group will have an education faculty member as an adviser. This person will attend meetings when possible, will be available to provide advice to members, and will help to create effective communication between EMSP members and UMM administrators and local school districts.
Section 2 Length of Term: The adviser will be approached by EMSP Executive Officers on a volunteer basis and his or her term will be annually renewable. If for some reason EMSP group decides by a majority vote that the adviser is not fulfilling his or her duties, another adviser may be asked to assume the adviser role.
     
Article VI: By-Laws
Section 1 By-laws may be proposed by the membership and may be adopted by a majority vote of those present at the meeting when a quorum is present.
     
Article VII: Amendments
Section 1 Process: Any memper may suggest an amendment to this constitution by presenting a hard copy of the suggested amendment to the Executive Officers.
Section 2 Notification: Members will be made aware of this recommendation by email and in the meeting following the submission of recommendation.
Section 3 Ratification: An amendment shall be instated if a majority votes to pass the
amendment. A quorum must be present to vote on an amendment.
Section 4 Approval: The ratified constitution will be submitted to the University of
Minnesota, Morris Student Services Committee for approval.
